Welcome to Clabaire. These Terms & Conditions (“Terms”) govern your access and use of our website, courses, lessons, images, audio clips, and other services (collectively, the “Services”). By accessing or using our Services, you agree to comply with these Terms. If you do not agree, please do not use our Services.

1. Accounts & Subscriptions

  • To access certain features, including courses, lessons, and premium content, users must create an account.
  • By creating an account, you agree to provide accurate and complete information and keep it updated.
  • Subscription plans may be required to access all content. Details on pricing, billing, and cancellation policies are available on our subscription page.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You may delete your account at any time via your account page, provided you have no active subscription.

2. Use of Services

  • Our website offers language-learning courses, individual lessons, images, and audio clips designed to help users improve their language skills.
  • You may use the Services solely for personal, non-commercial purposes.
  • Unauthorized distribution, reproduction, or resale of our content is strictly prohibited.
  • We reserve the right to modify, update, or discontinue any part of the Services at any time.

3. Subscription & Payments

  • Some content requires a paid subscription. Subscription plans, pricing, and payment terms are detailed on our website. The current price is shown at checkout in your local currency.
  • New subscribers are eligible for a one-time 14-day free trial. During the trial, no payment is taken and you may cancel at any time without charge. After the trial ends, your subscription will renew automatically at the price shown.
  • The 14-day free trial is available once per customer. Returning subscribers will be charged immediately upon resubscription, without an additional trial.
  • Payments are processed securely through Stripe. By subscribing, you authorise us to charge the applicable fees to your selected payment method on the agreed billing schedule (monthly, unless otherwise specified).
  • Subscriptions automatically renew at the end of each billing period unless cancelled beforehand. Users may cancel their subscription at any time via the billing page in their account. Cancellation takes effect at the end of the current billing period — you retain access to paid content until that date.

4. Right of Withdrawal (EU/UK Consumers)

  • If you are a consumer based in the European Union or the United Kingdom, you have a statutory right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day the contract is concluded (the day you start your subscription).
  • To exercise this right, cancel your subscription via your billing page, or contact us at support@clabaire.com within the 14-day period.
  • By starting your subscription and accessing our course content, you expressly request immediate access to digital content during the withdrawal period and acknowledge that you lose your right of withdrawal once you begin accessing the content (Article 16(m) of Directive 2011/83/EU).
  • During the 14-day free trial, no payment is taken and cancellation has no financial consequence.

5. Refund Policy

  • We do not generally offer refunds, as our 14-day free trial allows you to evaluate the Service before any payment is taken.
  • Refunds may be granted at our discretion, particularly in cases of accidental subscription, technical issues that prevented you from using the Service, or where required by law.
  • To request a refund, please contact us at support@clabaire.com within 14 days of the charge in question.
  • Refunds, when granted, are processed back to the original payment method via Stripe and may take 5–10 business days to appear on your statement.

6. User Conduct

You agree not to:

  • Share your account with others or allow unauthorised access.
  • Use our content for commercial purposes without permission.
  • Engage in disruptive, abusive, or illegal activities on our platform.
  • Violate copyright, trademark, or other intellectual property rights.

We reserve the right to suspend or terminate accounts that violate these Terms.


7. Intellectual Property

  • All courses, lessons, images, and audio clips on our website are owned by Clabaire or licensed to us.
  • You may not copy, distribute, modify, or create derivative works from our content without written permission.

Image Attribution

The homepage image, “Locator map of Ulster”, is used under the Creative Commons Attribution-ShareAlike 3.0 License. The original source is Ulster_locator_map.svg, created by NikNaks.

Any feedback or suggestions provided by users may be used by us without compensation or obligation.


8. Limitation of Liability

  • We do not guarantee that our Services will always be available, error-free, or uninterrupted.
  • We are not responsible for any loss or damage caused by reliance on our content for purposes beyond personal language learning.
  • To the extent permitted by law, our liability is limited to the amount you have paid us in the previous 12 months. We are not liable for indirect or consequential losses. Nothing in these Terms limits any liability that cannot be excluded under applicable law.

9. Privacy Policy

10. Termination

  • We may suspend or terminate your access to our Services at any time if you violate these Terms or engage in unauthorized activities.
  • Upon termination, any rights granted to you under these Terms will immediately cease. If you have an active paid subscription at the time of termination, we will refund the unused portion of your current billing period unless termination was due to your serious breach of these Terms.

11. Changes to These Terms

  • We reserve the right to update or modify these Terms at any time. Significant changes will be communicated via email or a notice on our website.
  • Continued use of our Services after changes means you accept the revised Terms.

12. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of Austria, without regard to conflict of law principles. If you are a consumer based in another EU country or the UK, you also benefit from the mandatory consumer protection provisions of the law of your country of residence.
  • The European Commission provides an Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr. Consumers may use this platform to resolve disputes with online traders. We are not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration board.
